Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before booking any courses, trips, or services operated by Diving is Pacific Ocean Company Limited.
By making a booking, paying a deposit, or using our website and services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access our services or book our courses.
1. Bookings and Payments
- Reservations: A booking is only considered confirmed once a deposit or full payment has been received and cleared by us.
- Pricing: All prices listed on our website are subject to change without prior notice. However, once a booking is confirmed, the price for that specific service is locked.
- Payment Methods: We accept payments via [Insert payment methods, e.g., Credit Card, Bank Transfer, PayMe, FPS]. Any transaction fees incurred are the responsibility of the client.
2. Cancellation and Refund Policy
Scuba diving is highly dependent on logistics, boat charters, and weather conditions. Our policy is as follows:

Client Cancellations: * Cancellations made more than [e.g., 14 days] before the scheduled activity will receive a full refund (minus any transaction fees).
- Cancellations made within [e.g., 7 days] of the activity may forfeit the deposit or be subject to a [e.g., 50%] cancellation fee.
- No-shows on the day of the course, pool session, or boat trip will receive no refund.

Weather & Safety Cancellations: The Captain of the vessel and/or the PADI Instructor has the ultimate authority to cancel a trip or training session due to unsafe sea conditions, typhoons, severe weather, or force majeure. In these cases:
- We will offer an alternative date to reschedule the session.
- If rescheduling is impossible, a refund or credit voucher will be issued. We are not liable for any personal travel or accommodation expenses lost due to weather cancellations.
3. PADI Standards & Medical Requirements
- Medical Fitness: In accordance with PADI standards, all students must complete the PADI Participant Medical Questionnaire before participating in any in-water training.
- Physician Clearance: If you answer “YES” to any health conditions on the form, you must obtain a signed medical clearance from a licensed physician stating you are fit to dive before entering the water. Failure to provide this clearance will result in the suspension of training without a refund for that day.
- eLearning & Homework: Students are required to complete all assigned PADI eLearning modules, quizzes, and exams before the practical pool/ocean sessions. Instructors reserve the right to refuse in-water training if a student is unprepared.
4. Equipment Rental & Liability
- Care of Gear: If you rent diving equipment from us, you assume full responsibility for its care.
- Damage or Loss: You agree to reimburse [Insert Company Name] at retail cost for any rental equipment that is lost, stolen, or severely damaged due to negligence or misuse.
- Proper Fit: It is your responsibility to verify that the rented gear fits correctly and functions to your satisfaction before leaving our facility or boarding the dive vessel.
5. Assumption of Risk & Liability Release
- Inherent Risks: You acknowledge that scuba diving, skin diving, and snorkeling are activities that carry inherent risks of injury, illness, decompression sickness, or death.
- Liability Release: Before commencing any practical in-water training or boat travel, you will be required to sign standard PADI Liability Release and Express Assumption of Risk forms. Refusal to sign these mandatory legal documents will result in immediate cancellation of your booking without a refund.
6. Code of Conduct and Safety
- Instructor Authority: For your safety and the safety of the group, you must strictly follow the directions and safety briefings given by our PADI Instructors, Divemasters, and boat crew.
- Substance Policy: Drinking alcohol or using recreational drugs before or during any diving activities is strictly prohibited. We reserve the right to bar any individual from entering the water if we suspect they are under the influence, without refund.
- Environmental Responsibility: We practice strict eco-friendly diving. Intentionally touching, disturbing, or damaging marine life or coral reefs may result in your immediate removal from the excursion.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong S.A.R., without regard to its conflict of law provisions.
